What to Expect in the Booking & Bail Process
When you have been arrested for DUI, you will go through the booking process. The booking process is the same for drinking and driving as it is for other criminal charges.
During this process, police will typically do the following:
- Gather your personal information (DOB, name, appearance)
- Write up a report of your alleged crime
- Conduct a background search on you
- Take fingerprints and photographs
- Search your person and confiscate any personal property
- Place you in a jail or holding cell
Once the booking process is complete, you will then have the opportunity to post bail. This is the process through which you can pay a certain set amount of money to secure your release from custody and essentially guarantee your appearance in court, lest you lose your money posted as bail. This means you must show up or have representation for the arraignment, preliminary hearing, pre-trial motions, and the actual trial.
If you can’t afford the bail, you may be able to seek out help from a bail bondsman or bail agency, which will cover the bail upfront in return for you or a small fee and collateral to cover the costs in case you decide to not show up to court.
