Penalties for Multiple/Aggravated DUI in AL
There is a look back period of five years in Alabama, which means any charges within that timeframe can be held against you when relevant for sentencing.
The following are the penalties for subsequent DUI offenses:
- 2nd offense: The penalties include up to a year in jail (mandatory 5 days in jail) and between $1,100 and $5,100 in fines with a year long license suspension (or two years of having an ignition interlock device installed on your car)
- 3rd offense: The penalties include between 60 days to a year in jail, up to $10,000 in fines and a 3 year license suspension (or having a three year ignition interlock device on your vehicle)
- 4th offense: This offense is considered a felony and will include between 1 and 10 years in jail, anywhere from $4,100 to $10,100 in fines, and a 5 year license suspension (or install ignition interlock device for a period of five years). There is also a mandatory, court-approved substance program.
- Aggravated DUI: If your BAC is .15 or higher, you may be charged with aggravated DUI, regardless of previous offenses. You will face higher penalties, depending on the number of offense and other factors involved.
