Whether you enter a pre-trial diversion program to avoid a DUI conviction or ultimately get convicted of drunk driving, you may be required to install an ignition interlock device (IID) on every vehicle you own and operate. This device prevents drivers from operating a vehicle while intoxicated and requires them to provide a breath sample before starting the vehicle.
In addition, drivers are also required to have their breath periodically tested while the vehicle is in motion. Although the vehicle will not shut off if the driver fails a breath test on the road, the results are recorded, and the car may not re-start after the vehicle comes to a stop.
In July 2019, a new DUI law in Alabama ensures even first-time offenders must install an IID in order to continue driving. If they do not choose to have an IID installed, then the driver’s license suspension will last up to 90 days.
A second conviction in 10 years will result in a mandatory license suspension period of one (1) year and up to two (2) years of IID installation. After the first 45 days of suspension, the remainder of the suspension period will be lifted if an IID is installed.
A third conviction in 10 years will lead to a mandatory license suspension period of three (3) years and up to three (3) years of IID installation. After the first 60 days of suspension, the remainder of the suspension period will be lifted if an IID is installed.
A fourth conviction in 10 years will result in a mandatory license suspension period of five (5) years and up to four (4) years of IID installation. After the first year of suspension, the remainder of the suspension period will be lifted if an IID is installed.
Drivers must pay for installation and monthly device monitoring and calibration. Furthermore, deciding to have an IID installed in order to reduce or stay a driver’s license suspension must also pay court costs.
