Even one DUI offense can severely impact your future, but more than one will undoubtedly change your life: your career, finances, and your very freedom will all be on the line. As you might suspect, DUI penalties for second and subsequent convictions become harsher each time.
- First DUI offense: For a first DUI, you may receive up to a year in jail, depending on the nature and circumstances of your offense, as well as a fine between $600 to $2,100. You will also be charged for the Impaired Drivers Trust Fund. Your driver’s license will be suspended for at least 90 days, and an ignition interlock device will be required if the driver had a BAC of 0.15% or more.
- Second DUI offense: You will face between 5 days to 1 year in jail, or a minimum sentence of 30 days of community service. A fine of $1,100 to $5,100 will be imposed, as well as a fee for the Impaired Drivers Trust Fund. Your driver’s license will be suspended for at least 1 year. An ignition interlock device is mandatory.
- Third DUI offense: For drivers who commit 3 DUI offenses within 10 years, the minimum sentence is 60 days to 1 year in jail, and a fine of $2,100 to $10,100. Your driver’s license will be suspended for 3 years. An ignition interlock device is mandatory.
- Fourth DUI offense: Prison time from 1 to 10 years, and a fine of $4,100 to $10,100. Your driver’s license will be suspended for 5 years. An ignition interlock device is mandatory.
Driver’s License Reinstatement Requirements in Alabama
Any DUI offense comes with a driver’s license suspension period, and driver’s license reinstatement is not automatic. The driver must pay a reinstatement fee to the Alabama Department of Public Safety (DPS) of at least $275, submit proof of financial responsibility, complete alcohol/drug treatment, education, and evaluation, and pass any written or road tests required by DPS.
